Is Wizards of Waverly Place a rip-off of Harry Potter and twilight?

Like in the intro they have a family photo that moves, the school they go to is IDENTICAL with the same uniforms, There teatcher is a cheap version of dumbledore, the story lines are always with warewolves and vampires. there are 3 main characters facing problems and the spells unlike HP's are tacky and cheap...is this just me?
